Draft — please have this reviewed before the site goes live. These terms are written to describe how Finest Painters actually quotes and carries out work, including the warranty wording already used on this site. They are a starting point, not legal advice, and they should be checked by someone qualified in Ontario contract and consumer law before the site goes live.

About these terms

These terms cover your use of this website and the estimates and work we provide. By using the site, or by asking us for an estimate, you accept them. If you are arranging work for someone else, you confirm you are entitled to accept these terms on their behalf.

In these terms, “we”, “us” and “our” mean Finest Painters, and “you” means the person or business we are dealing with.

Estimates and quotes

  • An estimate is our best judgement of what the work will cost, based on what we can see and on what you tell us at the time.
  • It is valid for 30 days unless it says otherwise.
  • It can change if the scope changes; if surfaces turn out to be in a different condition from how they appeared; if the paint or materials you choose cost more than we assumed; or if access to the work area is not what we were told to expect.
  • An estimate is not a contract. Work starts when you accept it in writing and we confirm a start date.

Price, deposits and payment

  • Prices are in Canadian dollars and include applicable taxes where the estimate says so.
  • Any deposit, its amount, and when the balance is due are set out on the estimate or the invoice.
  • Invoices are due on the terms shown on them. We may charge interest on overdue amounts.

Scheduling and access

  • Dates are given in good faith. Weather, the drying time between coats, the availability of materials, and the condition we find on arrival can all move them. We will tell you if a date has to change.
  • You agree to give us safe access to the work area, and to have water and power available. Please move or protect anything fragile or valuable before we start.

What we need from you

  • Tell us about anything that affects the work: previous coatings, moisture or water damage, earlier repairs, and any known problem such as lead paint or asbestos in a home built before 1990.
  • Choose your colours and confirm them in writing. Colour is applied as chosen, and a change after work has started may be chargeable.
  • Tell us about any building rules, permits or approvals that apply to your property.

Our workmanship

  • We carry out the work in a good and workmanlike manner and follow the coating manufacturer’s instructions.
  • Our workmanship is covered by the warranty stated on your estimate. Paint and other materials carry whatever warranty the manufacturer gives, not one from us.
  • The warranty does not cover normal wear and tear; damage from moisture, movement or settling in the building; damage caused by someone else after we have finished; or surfaces we did not prepare.
  • Please tell us about a problem within a reasonable time of noticing it, and give us the chance to look at it and put it right.

Paint, colour and finish

  • A colour can look different on a screen, and on a small sample, from how it looks on a finished wall. We will show you a sample and get your approval where the colour matters.
  • Where you supply the paint, we are not responsible for its quality or its finish, or for running out of it.

Cancellations

Please tell us as early as you can if you need to cancel or move a date, so that we can offer the slot to someone else. If work has already started, you are responsible for the work done and for materials already bought or ordered for your job.

Limits on our responsibility

To the extent the law allows, our responsibility for any claim relating to the work is limited to the amount you paid for that work. We are not responsible for indirect or consequential losses, such as the cost of temporary accommodation or of replacing items left in the work area. Nothing in these terms limits any right you have under the Consumer Protection Act (Ontario) or under any other law that cannot be excluded.

This website

  • The content here is general information. It is not a quotation for your particular job.
  • Photographs of completed work are representative. Every property is different, and a finish that suits one surface may not suit another.
  • We try to keep the site accurate and available, but we do not promise that it will be free of errors or interruptions.

Governing law

These terms are governed by the laws of the Province of Ontario and by the federal laws of Canada that apply there.
